Terms of service.

The basics.

  • The venue is BYO, however if you wish to SELL alcohol at your event you will be required by law to have a Liquor licence and all that comes with that. You will need to make contact with PNCC.

    Sundays Collective does not hold a liquor licence, it is your responsibility as the Hirer to determine if you need one.

    The areas immediately outside of Sundays Collective are a PNCC Liquor Ban Area, No Alcohol can be consumed outside of this area. We are also directly opposite the Police station… Please keep Alcohol inside.

    We recommend using a Bar Service to help manage alcohol service for large events. Some of our vendors offer this service.

  • Rubbish disposal ( limited to 2 large bags (provided) per event ) Please don’t use the Rubbish Bin to dispose of Recyclable material.

    We provide Bins for Brown Glass, Green Glass, and Aluminium Can Recycling.

    Please take care to sort accordingly. If significant sorting is required, we reserve the right to withhold a portion of Bond for the time it takes to sort. Again this is where a Bar Service is worth its weight in gold.

  • Rubbish disposal ( limited to 2 large bags (provided) per event ) Please don’t use the Rubbish Bin to dispose of Recyclable material.

    We provide Bins for Brown Glass, Green Glass, and Aluminium Can Recycling.

    Please take care to sort accordingly. If significant sorting is required we reserve the right to withhold a portion of Bond for the time it takes to sort. Again this is where a Bar Service is worth its weight in gold.

    We provide Cleaning Materials for clean up. This includes, Mop Bucket, Floor Cleaning Solution, Broom, Sweeper, Disposible Cloths, Surface Cleaner/ Sanitiser, Gloves and a Vacuum.

    Please ensure cleaning supplies and equiptment are left in a clean and tidy state.

  • Any matter left outside of the toilet which should be in it.

    Vomit or other bodily fluid anywhere on the premises.

    We reserve the right to add to this list as we discover what can happen in a venue….

  • All of our rooms are equipped with a Fire Extinguisher and a full emergency lighting and fire evacuation system.

    FIRE

    In the event of a fire Pull the Emergency Fire Alarm you will find in every room, Dial 111 and Leave the Building. As the Hirer of the Venue you will assume Fire Warden Duties for your space. Ensure all exits are open and all guests are vacated in a timely calm manner.

    Only if it is safe to do so, attempt to use the extinguisher on the fire

    The evacuation Point is across the road on the Grass outside Farmers.

    EARTHQUAKE

    Drop, cover, and hold on! Move only a few steps to a nearby safe place. Most injured persons in earthquakes move more than five feet during the shaking. It is very dangerous to try to leave a building during an earthquake because objects can fall on you. Many fatalities occur when people run outside of buildings, only to be killed by falling debris from collapsing walls.

The fine print

  • 1.1 In these Terms:

     “Event” means the purpose for which the Venue is to be hired as described by you in the Venue Hire Agreement.

    “Hirer” means the person named as the Hirer in the Venue Hire Agreement and is referred to as “you” in these terms.

    “Venue means” 397 Church Street, Palmerston North

    “Venue Hire Agreement” means the Agreement attached to these Terms.

    “Venue Hire Fee” is the venue hire fee referred to in the Venue Hire Agreement.

    “Hire Period” is the period in which the Hirer will hire the Venue referred to in the Venue Hire Agreement.

    “Venue Site Plan” is the plan of the Venue and areas (if applicable) outlining the area of the Venue being hired.

    “Deposit” is the initial non-refundable payment to be made by the Hirer as part of the Venue Hire Fee, to confirm the booking, as detailed in the Terms 4.1.2.

    “Bond” means the refundable bond (if any) detailed in the Specific Terms required by the Venue Operator in terms of clause 4.1.3 of the Terms.

  • 2.1 You may only use the Venues and areas (if applicable) as per the “Venue Site Plan” outlining the area of the Venue being hired.

    2.2 You may only use the Venue for the purposes as described in the description of the Event and between the start and finish times as per the Hire Period in the Venue Hire Agreement.

    2.3 You must ensure that all persons in which attended the event vacate the Venue prior to the finish time in the Venue Hire Agreement.

    2.4 You are responsible for setting up any decor and dismantling and removing it from the Venue. We have the right to charge a set up fee should you ask for us to set up any decor and/or a disposal fee for any decor that is left behind.

    2.5 You must remove all property of yours and your guests from the Venue at the end of the Event and leave all the equipment, facilities and Venue in a good, clean and tidy order.

    2.6 In respect of the Venue (except when Sundays Collective otherwise agrees) you must:

    2.6.1 Take proper care of the Venue and ensure no damage occurs.

    2.6.2 Not drive nails, tacks, screws or pins into the walls, furnishing, floors or ceilings, nor use sticky tape or blue tac.

    2.6.3 Not use or allow to be used in the Venue any form of lighting with a naked flame (including candles) unless at Sundays Collectives discretion or with prior consent from Sundays Collective.

    2.6.4 Guests must not roam into other Venues or other private events.

    2.6.5 Protect all floors, walls and doors at all times, for example, this includes during the installation and removal of any equipment.

    2.6.6 Not use any of the Venue’s equipment, fittings, heating, fixtures, ventilation systems other than for its intended purpose.

    2.6.7 Not deposit any substance in the toilets, sinks or drains that could cause a blockage or damage.

    2.6.8 Smoke/Vape only in the designated area.

    2.6.9 Not ignite any fireworks or sparklers in or outside the Venue

    2.7 If any damage is caused to the Venue or any item of furniture, fitting, fixing, fixture or chattel within the Venue, you must immediately notify a Sundays Collective staff member or representative of the damage in order that Sundays Collective can arrange for the damage to be repaired, such damage to be at your cost in accordance with clause 6.0 of these terms.

    2.8 The Venue must be returned to the standard at which it was presented at the commencement of the hire period.

    2.9 Any Soilage that occurs is not included in any Cleaning Fee, clean up of Soilage will be taken from Bond Money

  • 3.1 By signing the Venue Hire Agreement you agree that the Event is described accurately and comprehensively in the Venue Hire Agreement.

    3.2 You agree the Venue will not be used by you for any activity that is illegal, of objectionable nature, is in breach of reasonable standards of public decency or likely to create a nuisance.

    3.3 The number attending the Event must not exceed 120 persons.

    3.4 You agree Sundays Collective reserve the right to limit noise equipment brought in and/or generated by noise equipment brought in.

    3.5 The Venue must be vacated no later than midnight. This includes vehicles being removed from the carpark.

  • 4.1 Your booking at the Venue is only confirmed once:

    4.1.1 Return to Sundays Collective of the signed Venue Hire Agreement, and

    4.1.2. Payment of deposit.

    4.1.3 Payment of Refundable Bond (if required).

    4.2 Should you breach or fail to properly perform the obligations under these Terms, the Bond will be forfeited and the Venue Operator may use the Bond to carry out the obligations of the Hirer under the Venue Hire Agreement.

    4.3 On conclusion outlined of the Event and if the Venue has been left to the standard in clause 2.0 , the Bond money will be returned within 3 business days.

  • 5.1 You must pay Sundays Collective the Venue Hire deposit, specified in the Venue Hire Agreement within 7 days of confirmation by Sundays Collective.

    5.2 You must pay Sundays Collective the Venue Hire Bond (if applicable), specified in the Venue Hire Agreement within 7 days of confirmation by Sundays Collective.

    5.3 The Venue deposit is non-refundable.

  • 6.1 In addition to the Venue Hire Fee, you will be charged for:

    6.1.1 Any damage to the Venue or its chattels during the hire period caused by you, or that arises due to your lack of care or any breach of these Terms.

    6.1.2 Any theft of Sundays Collective property from the Venue during your hire period.

    6.1.3 Any extra cleaning, rubbish removal, repair or reinstatement of the Venue that Sundays Collective reasonably considers is required after your Event.

    6.1.4 Each hour or part of an hour at the rate of $500 plus GST you occupy the Venue after the finish time.

    6.1.5 Any costs, losses or expenses Sundays Collective incurs due to a breach or non observance by you of these Terms.

    6.1.6 Any costs incurred by a call out of an external organisation during the Hire Period which are not deemed to be true (for example, but not limited to, fire brigade, security etc).

    6.2 If applicable, you will be required to pay Sundays Collective a security bond of $500, including GST, you will be invoiced of this prior to the date of the Event. You authorise Sundays Collective to deduct the additional payments as reasonably assessed by Sundays Collective from this amount. The balance or full amount will be refunded to you after your event.

  • 7.1 You are responsible for all persons connected to the Event in which you are hiring the Venue for (volunteers, employees, contractors, sub-hirers, exhibitors or invitees) during the Hire Period.

  • 8.1 You are responsible for all aspects of promotion and sales of the Event, unless agreed otherwise.

    8.2 The Venue is to be referred to as Sundays Collective in any promotional material and/or media releases produced by you. Please ensure to use the correct logo.

  • 9.1 Tickets to the Event will not go on sale until “Sundays Collective” has received the Venue Hire Agreement signed by the Hirer together with the Deposit and Bond (if applicable).

    9.2 You are responsible for all aspects of promotion and sales of the event, unless agreed otherwise.

  • 10.1 Notwithstanding any other provision contained in these Terms, Sunday Collective may refuse admission to any person or require any person attending the Event to leave the Venue at the sole discretion of any Sundays Collective staff member or representative if the Sundays Collective staff member or representative reasonably believes that any person;

    10.1.1. Is affected by drugs or alcohol, or

    10.1.2 Is behaving in a disorderly or indecent manner, or

    10.1.3 Annoys or is offensive to any other person at the Event (including Sundays Collective staff member or representative), or

    10.1.4 Wilfully destroys or damages any part of the Venue, or

    10.1.5 Is a risk to the safety of others, safety of themselves, the safety of the Venue or any property within the Venue, or

    10.1.6 Refuses or Fails to comply with any lawful request of Sundays Collective staff or representative

    10.1.7 Enters into another Venue space in which they are not a guest of.

  • 11.1 If you cancel the Event Sundays Collective will retain the Venue Hire Deposit.

    11.2 If you cancel your Event one week prior to the Event, Sundays Collective will retain the full Venue Hire Fee and Deposit.

    11.3 Sundays Collective may cancel your booking and the Venue Hire Agreement if Sundays Collective reasonably consider that the staging of the Event or nature of the Event will, or might, contravene any statute, order, regulation, bylaw, rule or law, breach of public decency or any other requirements of public or local authority.

  • 12.1 The health and safety of all people attending the Event is an area where you and Sundays Collective have responsibilities. Sundays Collective will consult with you prior to the Hire Period to portray this.

    12.2 Sundays Collective has fire and earthquake procedures for the use of the Venue and emergency responses in general terms. You are required to have a designated person onsite to oversee this is carried out, should the situation arise.

  • 13.1 Sundays Collective is not responsible for loss or damage to any of your property in or around the Venue.

    13.2 Sundays Collective is not responsible for any loss or expense that you may incur in Sundays Collective is not able to make the Venue available to you as a result of fire, flood, earthquake, failure or unavailability of any building services or other event beyond the reasonable control of Sundays Collective. If the Venue is unavailable to you for any of these reasons, Sundays Collective will refund all deposits paid.

    13.3 Sundays Collective will not be liable to you, under contract, tort or otherwise, for any indirect or consequential loss arising under or in connection with the Venue Hire Agreement. The extent of Sundays Collective’s liability to you under or in relation to the Venue Hire Agreement for any loss, damage, claim or expense (whether due to the negligence of Sundays Collective or otherwise) is limited to the Venue Hire Fee.

    13.4 You indemnify Sundays Collective against all claims, demands, losses, damages, costs and expenses arising from your use or hire of the Venue or any breach of these Terms.

  • 14.1 You must comply, at your expense, with all applicable statuses, regulations, bylaws, consents, these Terms and Sundays Collective policies and procedures as seen as they relate to the use, occupation, safety and security of the Venue.

    14.2 You cannot transfer any of your rights or obligations under the Venue Hire Agreement.

    14.3 These Terms and Conditions shall apply to you, your employees, agents, contractors, and guests and you are responsible for ensuring compliance by such person with these Terms.

  • 15.1 If any dispute arises between you and Sundays Collective, we shall endeavour to negotiate a satisfactory outcome.

    15.2 If this dispute has not been resolved by negotiation within 10 days of either of us giving the other written notice of the dispute, the dispute shall be referred to mediation.

Alcohol Policy.

As the Hirer of the Venue you or the person you assign are responsible for getting guests out of your space. Ensure all exits are open and all guests are vacated in a timely calm manner.

EARTHQUAKE

The Sundays Collective Buildings are Earthquake prone, in particular the front Brick Room. The Building is largely made up of unreinforced brick making it a hazard in an earthquake. Although there is no definitive answer as to the best course of action in an earthquake most guidance says to get under large beams or doorways, Brace and Hold on. Leaving the building can be dangerous due to falling debris. If you do leave the building get to a space with no tall buildings - like the old freedom furniture building.
